Harvey Lembo in Rockland was sick and tired of having his apartment broken into by losers looking for drugs and money. Finally, on Monday, he bought a gun. It's a vintage revolver. He put it, loaded, under his pillow. Monday night, someone broke into his apartment. Harvey was ready!

Christopher Widhaber, 45 of Rockland, apparently thought the apartment would be an easy target. He was mistaken.

After being robbed four times previously, 67-year-old Lembo, who is disabled and in a motorized wheelchair, had enough.

As Lembo was on the phone with 911 holding the gun, Widhaber made a run for it.

"That's when I shot him, yes. I shot just like that. Just barely missed the side of the wall. Got him in the shoulder. If he'd have sat there, nothing would have happened. But he wanted to leave. And I've had enough of it. I've had enough."

Widhaber is in custody and the D.A. will decide if Lembo was justified in using deadly force.

According to Rockland Deputy Police Chief, Christopher Young, "He had definitely been the victim of numerous burglaries before this. So I can certainly understand the fear he might have had,"
